USCIS will resume premium processing on Monday, Jan. 28, for all H-1B cap petitions that remain pending from the April 2018 lottery. If you currently have a request for evidence (RFE) on your petition and have not responded to it yet, USCIS recommends that you include your RFE response with your premium processing upgrade.
This service is only available for pending petitions last year’s cap, not new submissions for this coming April. For all other types of H-1B petitions that were under the premium suspension since September, the premium processing suspension continues.
Premium processing remains unavailable for transfers, amendments, and extensions with change. We may expect an update regarding whether premium processing will become available for these other types of cases by February 19th.
